IMPORTANT: These Terms of Service (“Terms”) are a legal agreement between you and Cres Property Management governing your use of our website, online forms, and related online services (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

4) SITE PURPOSE / NO PROFESSIONAL ADVICE

The Site may provide general information about our property management services, available rentals, and tools to contact us or submit information. Content is provided for informational purposes only and is not legal, financial, or real-estate advice. You should consult appropriate professionals for advice tailored to your situation.

5) ELIGIBILITY

You must be at least 18 years old (or the age of majority where you live) to use the Site. By using the Site, you represent you meet this requirement.

6) ACCEPTABLE USE

You agree not to:

- Use the Site for any unlawful, harmful, or fraudulent purpose;

- Attempt to gain unauthorized access to the Site, accounts, systems, or networks;

- Interfere with or disrupt the Site (including attempting to probe, scan, or test vulnerabilities);

- Upload or transmit malicious code or attempt to scrape or harvest data without permission;

- Impersonate any person or entity or misrepresent your affiliation.

7) ACCOUNTS, PORTALS, AND THIRD-PARTY SERVICES

We may link to or integrate with third-party services (for example, resident/owner portals, payment processors, or scheduling tools). Those services are provided by third parties and may have their own terms and privacy practices. We do not control and are not responsible for third-party sites/services. Your use of third-party services is at your own risk and subject to their terms.

8) INQUIRIES, FORMS, AND COMMUNICATIONS

If you submit a form, request information, apply for a rental, or otherwise provide contact details, you consent to be contacted by us (including by phone, email, and text message) for service-related purposes and responding to your request. Standard message/data rates may apply.

9) RENTAL LISTINGS, AVAILABILITY, AND ACCURACY

We strive to keep listings and Site information current, but we do not guarantee completeness, accuracy, or availability. Prices, features, fees, availability dates, and other details may change without notice. Photos, floorplans, and descriptions are for marketing convenience and may not reflect the current condition of a unit.

10) APPLICATIONS, SCREENING, AND FAIR HOUSING

If you apply for a rental through the Site or via links we provide, you may be required to provide personal information and authorize screening (such as credit, background, employment, income, and rental history verification) as permitted by law and our screening criteria. We comply with applicable fair housing laws and do not discriminate based on protected characteristics.

11) INTELLECTUAL PROPERTY

The Site and its content (text, graphics, logos, design, and compilation) are owned by or licensed to Cres and are protected by intellectual property laws. You may view, download, and print pages for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit Site content without our prior written permission.

12) USER CONTENT

If you submit content (messages, reviews, uploads, etc.), you represent you have the right to do so and that it does not violate law or third-party rights. You grant Cres a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content as needed to operate, improve, or market our services (unless prohibited by law).

13) COPYRIGHT / DMCA

We respect intellectual property rights. If you believe content on the Site infringes your copyright, you may send a notice to us with sufficient details to identify the work and the allegedly infringing material, and your contact information. We may remove content and/or disable access where appropriate.

14) DISCLAIMERS

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

15) LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRES AND ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CRES’S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE EXCEED $100 OR THE AMOUNT YOU PAID TO USE THE SITE (IF ANY), WHICHEVER IS GREATER.

16) INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Cres and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of another.

17) GOVERNING LAW / VENUE

These Terms are governed by the laws of the State of Ohio, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Hamilton County, Ohio, and you consent to jurisdiction and venue there.

18) SEVERABILITY; WAIVER

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

19) ENTIRE AGREEMENT

These Terms, together with any policies referenced (including the Privacy Policy), form the entire agreement between you and Cres regarding the Site and supersede any prior agreements on the same subject.
